What fiscal cliff? Holiday shoppers shrug off budget debate

(Reuters) - The "fiscal cliff" drama that dominated the news and spooked businesses and financial markets did little to dampen spending by shoppers this holiday season.

A new Reuters/Ipsos poll shows nearly three-quarters of Americans said the debate around the fiscal cliff had no impact on their holiday spending. Fewer than 20 percent of those polled said they spent less during the season than they did in the 2011 holidays, according to the poll.

Holiday season sales overall - including December sales data from several chains due this week - were likely good, but not great. The expected rise in 2012 holiday spending is poised to show the smallest year-over-year gain since the recession led to a sales drop in 2008. Various estimates suggest that U.S. sales in November and December combined grew at a low single-digit pace, slower than in 2011 and 2010.

The fiscal cliff was a nearly constant topic in the news, as the country waited to see if politicians in Washington would reach a deal to avoid $600 billion in automatic spending cuts and tax increases.

On Tuesday, the U.S. Congress approved a bill that would raise taxes on the wealthy and preserve certain benefits. The vote averted immediate pain like tax hikes for almost all U.S. households, but did not resolve the issue of raising the federal debt ceiling and fights over the budget in coming months.

Seventy-three percent of those polled in the final days of December said concerns about the fiscal cliff did not affect their holiday spending at all, according to findings from an Ipsos poll conducted for Reuters. Back in mid-November, before the holiday season kicked into full gear, 58 percent of those polled had said the fiscal cliff was not affecting their holiday plans.

Only 15 percent of those polled in late December said they spent less during the 2012 holiday season because of the fiscal cliff. In mid-November, 28 percent said that they planned to spend less because of the fiscal cliff.

Fifty-seven percent of those polled said that they spent the same amount on holiday shopping in 2012 that they did in 2011. Nineteen percent said that they spent less than they did in 2011, while 17 percent said that they spent more.

The poll findings are from an Ipsos poll conducted for Thomson Reuters from December 27 to December 31, with 765 American adults interviewed online. Results are within the poll's credibility intervals, a tool used to account for statistical variation in Internet-based polling. The credibility interval was plus or minus 4 percentage points.

The poll is the latest in a series that Ipsos conducted during the holiday season.

COSTCO APPEARS STRONG, TARGET UNDER PRESSURE

Taking a look at various retailers, discount chains as a group likely saw the strongest sales growth last month, while profits at some retailers may have taken a hit from the need for sharp discounts to clear merchandise from shelves.

"Value and promotions drove consumers to the malls," according to Jharonne Martis, director of consumer research for Thomson Reuters. "Big discounts and promotions could cut into retailers' profit margins."

Costco Wholesale Corp is expected to post a 6.5 percent rise in December same-store sales. While Costco holds the highest estimate of any of the 17 chains included in the Thomson Reuters I/B/E/S tally of analysts' forecasts, the expectations are still below the 7 percent growth the chain posted in December 2011.

Still, some analysts are concerned about December sales from Target Corp. The discount chain appeared to struggle with efforts such as its highly touted collaboration of holiday gifts with Neiman Marcus, which Target marked down by 50 percent even before Christmas.

Target forecast a low single-digit percentage increase in December same-store sales. Jefferies analyst Daniel Binder said he expects such sales were just flat to up 1 percent, while JP Morgan analyst Christopher Horvers cut his expectation to a 0.5 percent increase after calling for a 2.5 percent rise.

Overall, analysts are looking for 3.7 percent same-store sales growth for December across 17 chains, down from 4.2 percent growth in December 2011, according to Thomson Reuters I/B/E/S. Such sales rose a disappointing 1.6 percent in November. In December 2008, same-store sales fell 3 percent, according to Thomson Reuters I/B/E/S.

"December's results will reflect a modest slowdown in overall spending over the past two months ... but the world is not ending," JP Morgan's Matthew Boss said in a note this week.

The weakest December same-store sales are expected to come from teen apparel chain Wet Seal Inc.

Monthly same-store sales tallies exclude major players such as Wal-Mart Stores Inc, Home Depot Inc and Best Buy Co Inc, as well as online leader Amazon.com Inc.

(AP) ? Dylan Thompson came off the bench to throw a 32-yard touchdown pass with 11 seconds remaining Tuesday, giving No. 11 South Carolina a 33-28 victory over No. 19 Michigan in the Outback Bowl.

Thompson replaced Connor Shaw during the winning drive, covering the final 43 yards after the Gamecocks' starter began the march from his own 30. Devin Gardner's third TD pass of the game had given Michigan a 28-27 lead.

Shaw threw for 227 yards and two touchdowns after missing South Carolina's regular-season finale against Clemson with a left foot sprain. Thompson led the Gamecocks (11-2) to a victory over their archrival and threw for 117 yards and two TDs as a backup Tuesday.

Gardner threw for 214 yards in his fifth start for Michigan (8-5) since Denard Robinson injured his right elbow in late October. Robinson took some snaps at quarterback, but lined up mostly at running back and rushed for 100 yards on 23 carries.

PFT: Cardinals aren't ready to give up on Kolb

Black Monday had a dual meaning this year.? In addition to seven coaches and five General Managers losing their jobs, every player suffered a defeat when Judge David Doty refused to permit a collusion claim against the NFL proceed.

Doty, who did the NFLPA a favor by issuing his ruling on the last day of the 2012 calendar year and the hectic first day of the 2013 offseason, ruled that the players had released all claims that could have been made against the league when signing off on the 2011 Collective Bargaining Agreement.? The NFLPA believes that Doty?s ruling is incorrect, and we?re told that the union is now considering its next move.

The options are limited.? The union can ask Judge Doty to take a second look at the issue (known in the legal industry as a ?motion for reconsideration?), the union can file an appeal to the federal court that oversees Judge Doty, or the players can punt, figuratively.? (Or literally, if they decide to wad up the written decision into a ball and kick it.)

The best move could be to move on.? Though the players believe the settlement agreement that released all claims that could have been made by the union (including a claim for collusion arising from an allegedly secret salary cap in the uncapped year of 2010) required formal court approval, it?s a technicality at best.? And judges tend to ignore meaningless technicalities that would point to an unfair result.

There are three reasons why the result would have been unfair.? First, if the lawyers had presented the paperwork to Doty for approval, he would have applied the rubber stamp and banged the gavel without giving the settlement agreement serious consideration.? Second, the NFLPA affirmatively accepted the cap penalties imposed on the Cowboys and Redskins that triggered the claim for collusion in order to obtain a higher per-team salary cap for 2012.? Third, and as we explained at the outset of this specific controversy, the NFLPA arguably ratified any collusion by agreeing to permit punishment to be imposed on the Cowboys and Redskins for failing to comply with the collusive behavior.

Judge Doty didn?t delve into those issues.? Indeed, he generally avoided in his 11-page written opinion any commentary that would have ?called out? the NFLPA or otherwise made the players or their leadership or their lawyers look bad.? Though there?s a good-faith argument to be made that court approval was required because the settlement encompassed a class action affecting the rights of hundreds of players, Doty likely took the simplest path from point A to point B, finding a way to end the case without embarrassing the NFLPA or chiding their counsel for trying to have it both ways.

If the NFLPA pushes the issue, the next opinion from Judge Doty or the appeals court (which has a reputation for being business friendly) could be more blunt regarding the failure of the NFLPA to assert the claim before signing off on the settlement agreement, the decision of the NFLPA to agree to cap penalties imposed on two teams who treated the uncapped year as, well, uncapped, and the arguably disingenuous idea that the NFLPA didn?t suspect collusion until after the Cowboys and Redskins were whacked for $48 million in cap space.

So, yes, the smartest move could be to wad the decision up into a ball and kick it.

'The Hobbit' holds on to first place with $32M

LOS ANGELES (AP) ? A tiny hobbit has a mighty hold on the box office, staying on top for a third-straight week and wrapping up a year that saw a record-breaking $10.8 billion in total annual grosses.

The Warner Bros. fantasy "The Hobbit: An Unexpected Journey" remained at No. 1 with $32 million for a total of $221.7 million, according to final studio figures Monday. That's slightly down from the Sunday estimate of just under $33 million but enough to retain first place in a holiday weekend that featured the much-anticipated debuts of awards contenders "Django Unchained" and "Les Miserables."

A year ago, Tim Tebow was a playoff-winning quarterback.

Sunday, he was again reduced to a fan with a good seat, as his little-used year with the Jets ended in familiar fashion.

He took one snap in Sunday?s finale, handed off to Joe McKnight, and then began a polite campaign for a real chance to start somewhere.

Asked whether he thought that chance would come with the Jets, he played nice.

?I?m not sure,? Tebow said, via Mike Vorkunov of the Newark Star-Ledger. ?That?s something we?ll have to look at and take a few days and sort it all out.?

Jets coach Rex Ryan was equally illuminating, saying ?Tim?s under contract. So we?ll see what happens.?

It?s obvious Ryan never wanted him, and will likely feel a great relief at not having to deal with the Tebow distraction continued to build.

Even as Mark Sanchez floundered, and the skipped him in favor of Greg McElroy, it was clear Tebow wasn?t going to see the field unless it was an emergency. And maybe not then.

?I?m trying to win the game and that?s it,? Ryan said. ?If I thought Tebow would have helped us win the game playing quarterback or defensive tackle, I would have played him.?

So obviously, he didn?t.

It appears the Jaguars are willing to, once they find a general manager who is willing to acquire him (which could limit their pool of candidates to those willing to go along with the owner?s apparent desire to bring the hometown hero back).

The Broncos proved last year that the Tebow experiment can be made to work, in a strictly controlled environment. Namely, with an excellent coach and a good supporting cast, both of which are tailored to his particular skill set.

The Jaguars, as presently constructed, can?t offer that.

But it seems like they?re willing to try, and it doesn?t take much reading between the lines to realize Tebow will welcome the opportunity, even if it?s not a good one.

(AP) ? The Chicago Bears reached the Super Bowl under coach Lovie Smith and consistently boasted a formidable defense.

However, they missed the playoffs too many times, never solved their problems on offense and even after a 10-win season they are moving on without him.

The Bears fired Smith on Monday after the team missed the playoffs for the fifth time in six seasons. General manager Phil Emery delivered the news to Smith on the day after the Bears beat Detroit to finish 10-6 but still didn't make the playoffs.

Hired in 2004, Smith led the 2006 team to the Super Bowl, but he also saw his team collapse in the second half of the past two seasons. He was let go with a year left on his contract, ending a nine-year run that produced an 81-63 record, three division titles and two appearances in the NFC championship game.

The Bears scheduled a news conference with Emery for Tuesday to discuss the move. Smith was not available for comment, but talked to the team after he was fired.

"He earned even more respect from me, if it was possible," quarterback Jay Cutler said. "He handled it the right way. A lot of character in that man, and it showed up."

Emery appears to be moving quickly in the search for a replacement.

A person familiar with the situation said Denver Broncos offensive coordinator Mike McCoy will interview for the Bears and Arizona Cardinals jobs this week. The person, who spoke to The Associated Press on Monday on condition of anonymity because he wasn't authorized to publicly speak about the interviews, said the talks would take place in Denver.

Even though Chicago closed with a win, the Bears needed a loss by Minnesota to get into the playoffs. The Vikings, though, beat Green Bay to clinch a postseason spot, leaving Chicago as the second team since the postseason expanded to 12 teams to miss out after a 7-1 start. The other was Washington in 1996.

Smith ranks third on the Bears' wins list behind George Halas and Mike Ditka.

The highlight of his tenure was the run to the title game that ended with a loss to the Indianapolis Colts. It was the first time two black coaches met for the championship, with Smith going against his mentor Tony Dungy.

The 2010 team lost to Green Bay in the NFC title game, but the Bears made the playoffs just three times and won three postseason games under Smith.

There was speculation he would be let go following the 2011 team's collapse, but he got one more year while general manager Jerry Angelo was fired. Now, he's out.

Return star Devin Hester was so upset he said he was considering retirement, adding, "I've got my workers' comp papers in my pocket."

Is he hurt?

"Not physically, but mentally," Hester said.

He wasn't ruling out playing next year, either.

While Smith was dismissed, there was no official word on the status of assistant coaches.

"I think we're going to get the best available coordinator, head coach, assistant coaches," Cutler said. "(I'm not going) to speculate where they're going to go. I have no idea. But I trust Phil and everyone involved in the search, and they're going to make the best decisions they can make."

Known for solid defenses, Smith oversaw a unit that was consistently effective and at times ranked among the league's best with stars such as Brian Urlacher, Lance Briggs and later Julius Peppers. Smith emphasized taking the ball away from the opposition, and no team did it more than the Bears with 310 during his tenure.

But on the other side, it was a different story.

Smith went through four offensive coordinators in Terry Shea, Ron Turner, Mike Martz and Mike Tice. He never could find the right formula, even as the Bears acquired stars such as quarterback Jay Cutler and receiver Brandon Marshall over the years.

Smith had no bigger supporter than team matriarch Virginia McCaskey, but the fans seemed split on him.

"The media, the false fans, you all got what you all wanted," Hester said. "The majority of you all wanted him out. As players we wanted him in. I guess the fans ? the false fans ? out-ruled us. I thought he was a great coach, probably one of the best coaches I've ever been around. He brought me in."

History suggests fans hoping for a high-profile replacement such as Bill Cowher or Jon Gruden might be disappointed. The last time the Bears went with an experienced NFL head coach was when Halas returned to the sideline in 1958.

They might, however, go with an offensive-minded coach for the first time since Mike Ditka was fired after the 1992 season, given the issues in that area.

That the Bears would be in this spot seemed unthinkable after they won seven of their first eight games, but the schedule took a tougher turn. Injuries mounted and so did the losses. It was similar to last season when they finished 8-8 after a 7-3 start, a collapse sparked by a season-ending injury to Cutler.

Dismissing Smith was the first move in what looks like a busy offseason. Urlacher has an expiring contract and was limited by knee and hamstring injuries this year.

The Bears might have a decision to make on Cutler, who has one more year left on his contract.

"I think, first and foremost, their concern is going to be with finding coaches, and we'll address it from there," he said.
