    Hill campaign cancels ads, polling, travel

    HELENA, Mont. (AP) ? Republican gubernatorial candidate Rick Hill's campaign has had to freeze media advertising, polling and travel since last Thursday to comply with a state judge's order not to spend a disputed $500,000 donation, his campaign manager said Monday.

    Brock Lowrance testified as attorneys for Hill's opponent, Democratic Attorney General Steve Bullock, asked District Judge Kathy Seeley to issue a preliminary injunction preventing Hill from spending the $500,000 donation for the Nov. 6 election.

    Seeley did not make an immediate ruling Monday. Her temporary restraining order preventing Hill from spending the donation was to remain in place for at least another day while Hill's attorney prepared a legal filing.

    Lowrance said the campaign has raised more than $160,000 since Seeley issued her order last Thursday, and the campaign could use that money to start running ads on television again as soon as Monday evening.

    The sudden cash infusion was originally seen to be a boost to the former congressman's campaign as it entered the final stretch of a close race, but Lowrance testified that Seeley's order issued Thursday has had the opposite effect.

    The order was "overly broad" and the $500,000 donation was not easily separated from other contributions, so the campaign canceled nearly all expenditures and activities, Lowrance said.

    "We're effectively dark on radio and television right now. Not effectively ? we are," he said. "We did not want to violate, or even have the idea of violating the temporary restraining order."

    That means no Hill advertisements have run on television, radio or the Internet since Thursday, with the exception of four television ads on Saturday that could not be recalled in time. In addition, the campaign has halted about $10,000 in polling, which Lowrance said is essential for campaign strategy in the last weeks of the election, and put a hold on a statewide get-out-the-vote tour scheduled this week.

    Hill did travel to debates in Great Falls on Friday and Bozeman on Saturday, and the campaign continues to raise money, Lowrance said.

    The campaign was awaiting approval from its attorney before spending the money it has raised since Seeley's order. Lowrance said the top priorities were television ads and travel.

    Bullock attorney Karl Englund said the Hill campaign "overreacted" by shutting down most campaign operations, when Seeley's order was clear in that only the GOP donation was to be held. The attorney general's campaign said the former congressman is now being disingenuous in looking for sympathy.

    "Congressman Hill is trying to play the victim, which is ironic because he's the one who thinks he is above the law," campaign spokeswoman Kate Downen said.

    At issue is the legality of the $500,000 donation that Hill accepted two days after a federal judge ruled this month that state campaign contribution limits are unconstitutionally low. Hill argues that it was legal for him to take the GOP donation because of U.S. District Judge Charles Lovell's ruling, and he has spent most of it.

    Bullock argues Hill must return the donation now that the 9th U.S. Circuit Court of Appeals blocked Lovell's order and reinstated the limits. Bullock says the limits prevent Hill from taking more than $22,600 from all political parties from the beginning to the end of the campaign, and so Hill is now violating state law by keeping the $500,000.

    A $500,000 donation unexpectedly appearing in a statistically even race just a few weeks before the election could mean the difference in the election, testified political consultant and strategist Raymond Strother.

    "It would be catastrophic for the person who's going to have $500,000 spent against him," Strother said.

    Hill attorney Cory Swanson said state law prevents a campaign from receiving a donation above the limits, but there is no violation in keeping a donation that was legally made. That's the difference in this case, Swanson said, in which Hill accepted an above-the-limit donation when there were no limits.

    Swanson asked Seeley to dismiss Bullock's lawsuit, saying the attorney general is trying to skirt the normal complaint procedure, which is to go through the state commissioner of political practices.

    Bullock has filed a complaint with the commissioner, and Englund said the candidate also was within his rights to go to district court.

    DETROIT -- Aside from a few slips of the tongue, Tim Lincecum has been nearly perfect this postseason in his new role.

    The Giants right-hander added yet another chapter of dominance out of the bullpen on Saturday night as he delivered 2 1/3 shutout innings in a 2-0 victory over the Detroit Tigers in Game 3 of the World Series.

    Lincecum followed 5 2/3 scoreless innings from starter Ryan Vogelsong with three strikeouts and limited the Tigers to a walk. In 13 innings as a reliever this postseason, Lincecum has a 0.69 ERA and 17 strikeouts while allowing only three hits and two walks.

    If the two-time Cy Young Award winner harbors any disappointment after he was removed from the rotation before the World Series, it hasn?t surfaced in his performance.

    The Giants send Matt Cain to the mound in Game 4 at 5:07 p.m. on Sunday against Detroit?s Max Scherzer in search of their second World Series title in three seasons.

    ?The second we got that ring, it?s like that taste for that next ring is just sitting right in your mouth the whole time,? Lincecum said before he decided to reword his statement. ?That sounds terrible. Let me rephrase that. It just leaves you wanting it even more, and if that means being a good teammate or being in the bullpen, I really don?t care. I just want to win.?

    In his only 2012 postseason start, Lincecum allowed four earned runs, six hits and walked three in 4 2/3 innings in a loss at St. Louis in Game 4 of the National League Championship series.

    The Oct. 18 performance came on the heels of a regular season in which Lincecum -- a Cy Young winner in 2008 and 2009 -- finished with a 5.18 ERA, the worst among qualifying National League starters.

    But the bullpen has been a different story.

    Lincecum?s 0.69 relief ERA is the 11th lowest in major league postseason history for pitchers with at least 13 innings.

    If he?s unhappy with his temporary role, it?s yet to be detected by teammates and coaches, who said they?re impressed with how he has handled the transition.

    ?He could have been upset about going to the bullpen, and not one second did you ever see that from him,? Vogelsong said. ?He just went down there and came out firing BBs, and he?s been really impressive.?

    ?He has relished the role,? manager Bruce Bochy said. ?He accepted it and really acted like he looked forward to helping the club in that role, and that?s why I think he?s having success.?

    He must have really relished Saturday?s opportunity.

    After he took over for Vogelsong in the bottom of the sixth inning with a man aboard and two outs, Lincecum got Jhonny Peralta to line out to right-center field. He defused a potential seventh-inning rally after he walked Austin Jackson with two outs with a three-pitch strikeout of Quintin Berry, the last two strikes swinging.

    But Lincecum saved his best for the eighth when he retired Triple Crown winner Miguel Cabrera on a grounder to short and struck out cleanup hitter Prince Fielder on three pitches. After Delmon Young reached on Brandon Crawford?s throwing error, Lincecum finished the frame with a strikeout of Andy Dirks.

    Not only was Lincecum?s changeup effective, his fastball topped 93 mph.

    ?He definitely has an air about him,? catcher Buster Posey said. ?It?s confidence. And the stuff is really, really good. The fastball has movement I haven?t seen in a while. I don?t know exactly why that is, but I?ll take it.?

    Reliever George Kontos thinks he has the explanation. Lincecum has been ?airing it out? in the bullpen because he doesn?t have to preserve anything for later innings. Instead of pitching deep into a game, Lincecum can use his entire arsenal knowing he?ll only need to 30-plus pitches.

    ?He?s not worried about pacing himself,? Kontos said. ?He?s going batter-by-batter and he?s just giving the hitter everything he has got and he?s got some pretty good stuff.?

    (AP) ? Syrian troops shelled rebellious suburbs of Damascus and clashed with rebel fighters in several other areas of the country Sunday, the third day of what was meant to be a four-day holiday truce, activists said.

    A U.N-backed truce declared for the Muslim holiday of Eid al-Adha has so far failed to take hold, with fighting reported from the start. Activists said more than 150 people were killed Friday, the start of the holiday, and more than 120 people on the second day, on par with previous daily casualty tolls.

    The cease-fire was seen as a long shot. The international mediator in Syria, Lakhdar Brahimi, failed to get firm commitments from all combatants. At least one rebel-linked radical Islamic group, Jabhat al-Nusra, rejected the truce outright.

    The truce was called as the two sides were battling over strategic targets in a largely deadlocked civil war. This includes a military base near a main north-south highway, the main supply route to Aleppo, Syria's largest city, where regime forces and rebels have been fighting house-to-house. It appears each side feared the other could exploit a lull to improve its positions.

    With the unraveling of the cease-fire, it's unclear what the international community can do next. The holiday truce marked the first attempt in six months to reduce the bloodshed in Syria, where activists say more than 35,000 people have been killed in 19 months.

    Brahimi has not said what would follow a cease-fire. Talks between Assad and the Syrian opposition on a peaceful transition are blocked, since the Syrian leader's opponents say they will not negotiate unless he resigns, a step he has refused to take.

    In renewed fighting Sunday, regime troops shelled the eastern Damascus suburbs of Arbeen, Harasta and Zamalka to try to drive out rebels there, according to the Britain-based Syrian Observatory for Human Rights, which compiles information from activists in Syria.

    Another activist group, the Local Coordination Committees, said regime forces shelled Arbeen and Harasta, adding that eight people were killed Sunday in Damascus and its suburbs.

    Both groups also reported regime airstrikes in the area. However, amateur video posted online Sunda appeared ambiguous. One video showed two huge clouds of smoke rising from what was said to be Arbeen, and the sound of an airplane could be heard in the background. However, it was not clear whether the video showed the aftermath of shelling or an airstrike.

    The video appeared consistent with Associated Press reporting in the area.

    In Douma, another Damascus suburb, rebels wrested three positions from regime forces, including an unfinished high-rise building that had been used by regime snipers, according to the Observatory and Mohammed Saeed, a local activist.

    Fighting was also reported near Maaret al-Numan, a town along the Aleppo-Damascus highway that rebels seized earlier this month. Opposition fighters have also besieged a nearby military base and repeatedly attacked government supply convoys heading there. The Observatory said the Syrian air force fired missiles and dropped barrel bombs, or makeshift weapons made of explosives stuffed into barrels, on villages near the base.

    The Syrian government has accused the rebels of violating the cease-fire from the start. The state-run news agency SANA said opposition fighters carried out attacks in a number of areas, including in Aleppo and the eastern town of Deir el-Zour.

    Wellness Soliloquy: I Support a National Grief Awareness Day

    My friend, Angie Cartwright is petitioning to Washington, DC for a National Grief Awareness Day.? I have done just as much as I possibly can to support her efforts.? When people ask me why we need a?day set aside, my answer is quite simple:??To educate everyone about the grief process and how to better help those affected by loss.

    Grief is such a personal thing, and no two people react to loss the same way.? Unfortunately, we live in a society where we are encouraged to just "get over it".? We're rushed through each stage of grief by friends and family who think they are helping us along.? In fact, this suppression of emotion can have some adverse affects on our health and well being.

    ScienceDaily (Jan. 10, 2012):? According to a study?published in the American Heart Association journal,?the death of a close loved one could raise the risk of heart attack of those grieving by as much as 20 times the normal risk.? Of the 2,000 people interviewed, 270 reported that they had lost a significant other in the last 6 months.? Of those 270 people, 20 of them had lost loved ones the day before their heart attack.?"The risk was high not only the following day, but also remains high for quite some time," said Elizabeth Mostofsky, M.P.H, ScD., noting that the risk was also higher if the person said the loss was moderately or extremely significant to them.? As part of the multicenter Determinants of MI Onset Study, researchers reviewed charts and interviewed patients while in the hospital after a confirmed heart attack between 1989 and 1994. Patients answered questions about circumstances surrounding their heart attack, as well as whether they recently lost someone significant in their lives over the past year, when the death happened and the importance of their relationship.

    "Caretakers, healthcare providers, and the bereaved themselves need to recognize they are in a period of heightened risk in the days and weeks after hearing of someone close dying," said Murray Mittleman, M.D., Dr.P.H., a preventive cardiologist and epidemiologist at Harvard Medical School's Beth Israel Deaconess Medical Center and School of Public Health's epidemiology department in Boston, Mass.

My disease is much better managed today because when I feel a need to talk with others who have experienced loss, I go to the GTU support group and there I'm able to speak with others who have walked this lonesome?path and gain strength and coping skills to move on with life.?

    Most people believe they just have to suppress their grief or ignore their feelings.? They return to work too soon in an effort to "get their mind off of things", which may seem like the right response at the time, but eventually they have to come to grips with the reality and finality of their grief.? There is no right or wrong way to grieve, but holding in all?of that pain can definitely degrade a person's health as well.?

    It's ridiculous to put a time limit on grief.??What gives anyone the right to say when a person should be "over it".? You never get "over it", but you have no choice but to just get on with it.? It's imperative that we make?those who have not experienced the loss of a loved one aware that grieving doesn't stop after just a week, month or even a year.??For some people, grief can last a lifetime!? Everyone is different.? These are issues that need to be addressed and understood through education.??

    There needs to be a greater sensitivity to those who have suffered massive amounts of loss in their life.? To have a day set aside for education, coping method videos and lectures?to teach?people how to interact more effectively with those who grieve, we will abolish the ignorant stigma that clouds our society and make grieving socially acceptable.? No one needs to have?the pain of loss pinned up inside with nowhere to turn for support.

    How great would it be if tools were in place to help all of us help each other through the grieving process?? Support is so wonderful - on the giving end and on the receiving end.? It's such a win/win!? Grief in the United States has been?almost "taboo".? We don't speak of it in mixed company and we barely acknowledge it with other loved ones.? We?feel as though we need to wear a fake smile and a mask in order to keep from being a "downer" with friends and family.??

    I've read tragic stories about young children who have experienced loss of?friends at school?and were actually?made fun of by others when they would show emotion.? Even as little children, we're encouraged to just "buck up" and keep our?emotions intact.? These children carry this heavy burden of loss?with them into adult life.? This strikes me as not only sad, but cruel.? We claim to be compassionate human beings, yet we don't have any compassion on children who are grieving?? Something is seriously?wrong with that.

    You know, loss is not a respecter of persons.? Whether you are fat or?skinny, rich or?poor, at any given moment, anyone can lose a significant other.? It happens so quickly, and it is a life-changing event.? Your life after loss will never be the same again!? No matter how far along in your journey you are, you have to develop a new "normal" and to adjust to that new "normal" takes longer for some folks than it does?others.? Don't we owe these people one day a year to educate and arm others with helpful information about grief and the grieving process?? Is that really too much to ask?

    I don't think so.

    We need education in place to teach individuals how to treat those who are grieving.? Some people who grieve do not have any type of support group around them.? Some, like me, are fortunate to find groups on facebook, but most are on their own.? A person in grief will usually not ask for any kind of help.? They will keep their feelings bottled up and continue to live their lives as best they can.? Even when people say things like, "if you need anything, just ask", the person grieving will not ask.? And after a certain amount of time, people don't bother to even ask if the person grieving needs anything.

    Bottom line:? People who are grieving just need to be validated, heard and understood.? We want a day set aside not only to remember those we have lost, but to put information into people's hands that will help them learn to communicate and listen with more sensitivity and compassion to those who grieve.

    Definitions of U.S. Copyright Laws Restricts Smartphone, Tablet Users

    In a review of the Digital Millennium Copyright Act, also known as the DMCA, that first made it legal to jailbreak devices, the U.S. Copyright Office has now made definitions of copyright laws that limit the benefits to owners of smartphones and tablets. According to the U.S. Copyright Office, owners of smartphones may continue to legally jailbreak or root their devices, but that protection doesn?t extend to tablets.

    According to Wired, the Office feels that extending a blanket coverage to tablets would be dangerous as tablets are beginning to encompass more categories of devices, from large handheld portable game consoles to e-readers. However, given that smartphones with increasing displays?like the 5.5-inch Galaxy Note II?and smaller sized tablets are beginning to converge, it?s unclear where the Office?s arbitrary delineation of categories begin and end.

    And though it may be legal still to jailbreak smartphones according to the DMCA, users who do so may still void their warranties and manufacturers and carriers often do not support devices with tampered or altered software.

    Additionally, unlocking phones?also known as SIM unlocking?may require the blessing of the carriers themselves. According to the Office, users are given a license to use the software on their devices, not given the right to own said software. Hence, users will need permission from the software owners, or the carriers, to legally unlock a smartphone beginning on January 1, 2013.

    The difference between jailbreaking/rooting and unlocking are mainly that the latter applies to special code that ties the phone?s or tablet?s hardware to a particular carrier. As carriers in the U.S. subsidize devices in exchange for a two-year contract, those carriers would want users to remain with them for at least two years and locking a device would make it difficult for users to switch to a different carrier and reuse the same equipment. A simple code can be issued to unlock the phone to operate on a different carrier and used with a different SIM card.

    Jailbreaking or rooting, on the other hand, expands the software restrictions of a device. For instance, some carriers may ban tethering or not allow a certain video app to stream over its 3G/4G network. Jailbreaking would allow a user to remove those restrictions and further customize their devices to their own choosing.

    Pandora, Clear Channel, Others Form Lobby Group for Lower Web Radio Payments; MusicFirst Pushes Back

    Pandora and Clear Channel are among the founding members of the Internet Radio Fairness Coalition, a collection of companies, trade associations and advocacy groups announced today that are throwing their weight behind bills that aim to lower the rates webcasters pay for the performance of sound recordings.

    The group's namesake is the Internet Radio Fairness Act of 2012, legislation that seeks lower webcaster royalties by changing how the Copyright Royalty Board (CRB) sets rates. The proposed legislation would replace the "willing buyer and willing seller" standard with the 801(b) guidelines used by satellite radio and cable. Using the 801(b) guidelines would allow the rates to be set using criteria that take into account the public interest, the return earned by copyright owners, the minimization of risk in the industry, and the interplay between creative contribution and capital investment.

    Other founding members of the coalition include Consumer Electronics Association, terrestrial broadcaster Salem Communications, AccuRadio, Small Webcaster Alliance and Computer and Communications Industry Association.

    Record labels and webcasters have different definitions of fairness. Record labels will be putting their support behind a bill, currently in draft form, by Congressman Jerrold Nadler that proposed to bring satellite radio and cable radio rates up to the level of webcasters.

    Each side should have a chance to speak on the record soon enough. Sources say a Congressional hearing is likely in either late November or early December.

    Clear Channel has already found some market-based solutions. The company has negotiated direct licenses with Big Machine Label Group and Glassnote Entertainment that cover both terrestrial and webcasting royalties. Terms of those deals have not been disclosed.

    "We believe that market-based solutions are the way to go," said Bob Pittman, CEO of Clear Channel. "But in the absence of these agreements, the CRB needs to have and consider more relevant information so they are better? able to develop a rate structure that will lead to a healthy, sustainable Internet radio marketplace."

    musicFIRST quickly came out against the creation of the coalition. Executive Director Ted Kalo said in a statement that supporters of the bill were trying create momentum where none exists. "This bill is now commonly known as the 'Screw Artists Act' because it would produce a windfall to millionaires, mandate a pay cut for artists, and provide no benefits to subscribers."

    The organization says artists, music creators and other people wrote over 11,000 letters to Congress opposing the Internet Radio Fairness Act last weekend.

    We know Pocket has had a strong presence on iOS, Android and other platforms for quite some time now, but today the service formerly known as Read it Later announced it is now making its way to a bigger Cupertino screen. Naturally, Pocket's new application isn't much different than its mobile versions, meaning it'll offer the same offline access, save-for-later features as it currently does on the mobile front but with a more "native Mac experience" -- of course, this includes the ability to sync across multiple devices, stream videos and share tidbits via those cherished social networks. What's more, Pocket won't be charging a dime for its novel and handy OS X app, though this shouldn't come as a surprise given the outfit's somewhat recently adopted no-cost model -- still, it's a gesture most people will certainly appreciate, and one you Mac folk can start enjoying now by downloading from to the desktop-based App Store.

    Abstract (provisional)

    Background

    Androgen receptor (AR) signalling is critical to the initiation and progression of prostate cancer (PCa). Transcriptional activity of AR involves chromatin recruitment of co-activators, including the p300/CBP-associated factor (PCAF). Distinct miRNA expression profiles have been identified in PCa cells during the development and progression of the disease. Whether miRNAs regulate PCAF expression in PCa cells to regulate AR transcriptional activity is still unclear.

    Methods

    Expression of PCAF was investigated in several PCa cell lines by qRT-PCR, Western blot, and immunocytochemistry. The effects of PCAF expression on AR-regulated transcriptional activity and cell growth in PCa cells were determined by chromatin immunoprecipitation, reporter gene construct analysis, and MTS assay. Targeting of PCAF by miR-17-5p was evaluated using the luciferase reporter assay.

    Results

    PCAF was upregulated in several PCa cell lines. Upregulation of PCAF promoted AR transcriptional activation and cell growth in cultured PCa cells. Expression of PCAF in PCa cells was associated with the downregulation of miR-17-5p. Targeting of the 3'-untranslated region of PCAF mRNA by miR-17-5p caused translational suppression and RNA degradation, and, consequently, modulation of AR transcriptional activity in PCa cells.

    Conclusions

    PCAF is upregulated in cultured PCa cells, and upregulation of PCAF is associated with the downregulation of miR-17-5p. Targeting of PCAF by miR-17-5p modulates AR transcriptional activity and cell growth in cultured PCa cells.
